Tax Lien Proposal

Over the past year, the Louisiana State Law Institute , Tax Sale Committee has met regularly to discuss tax sales. One proposal, among others, is a switch from tax sales to a tax lien system which is employed by some other states. I, for one, am not a fan of the tax lien system for a couple reasons. First, with the uncertainty we already have about the amendment to Title 47 in 2009, substantially changing the law would mean years of more uncertainty. The second thing is, under the tax lien system it is not a way of gaining any sort of title to the property, the end result for investors is competing for the property at a tax sale.
